Terms of Service

1. Acceptance of Terms

By downloading, installing, or using EggWise ("App," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service following notice of changes constitutes your acceptance of the revised Terms.

2. Description of Service

EggWise is a fertility wellness application that provides tools for cycle tracking, health logging, AI-powered insights, medication reminders, and connection with fertility healthcare providers. EggWise is intended for informational and wellness purposes.

EggWise is NOT a medical device and does NOT provide medical diagnoses, treatment plans, or professional medical advice. Always consult a qualified healthcare provider for medical concerns.

3. Eligibility

You must be at least 18 years of age to use EggWise. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Promptly notify us of any unauthorized account access
• Not share your account with others
• Not create accounts for others without their consent

5. Subscriptions and Payments

EggWise offers free and premium subscription plans. Premium features require an active paid subscription.

Billing: Subscriptions are billed in advance on a monthly or annual basis through the applicable app store or via Stripe. Prices are subject to change with notice.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.

Refunds: Refunds are issued at our discretion and in accordance with applicable app store policies.

6. Appointment Payments

When booking paid consultations with healthcare providers through EggWise, payment is processed securely via Stripe. Appointment fees are set by individual providers. Cancellation and refund policies for appointments are determined by the respective provider and will be disclosed at time of booking.

7. Health Information Disclaimer

The content provided by EggWise, including AI-generated insights, wellness scores, educational articles, and medication information, is for informational purposes only and does not constitute medical advice.

Do not disregard, avoid, or delay obtaining medical advice from a qualified healthcare professional because of information you have read or received through EggWise. In case of a medical emergency, call emergency services immediately.

8. User Conduct

You agree not to use EggWise to:

• Upload false, misleading, or fraudulent health information
• Harass or harm other users or healthcare providers
• Circumvent security features or access unauthorized areas of the Service
• Use the Service for any unlawful purpose
• Reverse engineer, decompile, or create derivative works from the App
• Scrape or extract data from the Service in an automated manner

9. Community Conduct & Zero-Tolerance Policy

EggWise has zero tolerance for objectionable content or abusive behavior in our community spaces. By posting, replying, or otherwise contributing user-generated content (UGC) to EggWise community surfaces, you agree to the following rules without exception:

You will NOT post content that:

• Harasses, threatens, intimidates, bullies, or doxes another user
• Contains hate speech, slurs, or content targeting a protected class
• Is sexually explicit, contains nudity, or sexualizes minors in any form
• Promotes self-harm, suicide, eating disorders, or dangerous home medical procedures
• Provides medical advice that could cause physical harm to other users (e.g. directing others to stop prescribed medication)
• Contains spam, commercial solicitation, malware links, or off-topic promotion
• Impersonates another person, healthcare provider, or EggWise staff
• Violates any applicable law or third-party rights

Enforcement. All community content is screened by automated AI safety classification (Gemini) on submission and is subject to human moderator review. We act on reports of objectionable content within 24 hours. Posts that violate these rules will be removed without notice. Users who repeatedly violate these rules, or who post severe violations, will have their accounts suspended or permanently terminated, and we may report illegal content to appropriate authorities.

Reporting and blocking. Every post and reply includes a Report button to flag objectionable content for moderator review, and every author can be blocked individually, once you block a user, their content is immediately hidden from your view. Reports go to legal@myeggwise.com and are triaged by a human moderator within 24 hours.

No medical authority. Community posts represent personal experiences only. They are not medical advice, and EggWise does not endorse any treatment, supplement, or product mentioned by another community member. Always consult your own clinician.

10. Intellectual Property

All content, features, and functionality of EggWise, including text, graphics, logos, icons, and software, are owned by or licensed to EggWise Inc. and are protected by copyright and other intellectual property laws.

You retain ownership of health data you input into the App. By using EggWise, you grant us a limited license to process and store your data to provide the Service.

11. Third-Party Services

EggWise integrates with third-party services including Firebase, Stripe, and Google (Gemini AI). Your use of these integrated services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

12. Limitation of Liability

To the maximum extent permitted by applicable law, EggWise Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

In no event shall our total liability to you exceed the amounts you paid to EggWise in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

15. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time from your Profile settings.
